Fugitive diamond merchant Mehul Choksi alleged that his arrest for illegal entry into Dominica was done at the 'instigation' of the representatives of the Government of India. He has filed a case in the High Court of Rosseau, seeking quashing of the proceedings against him. According to local media reports there, a case has been registered against the Caribbean country's immigration minister, its police chief and the investigating officer of the case. Choksi has been living in Antigua and Barbuda since 2018 after absconding from India and went missing and was arrested in neighboring Dominica on May 23 for illegal entry. Dominica's immigration ministry declared him a restricted immigrant. He is wanted in connection with the Rs 13,500 crore scam in Punjab National Bank.
The diamantaire moved the High Court in Dominica, alleging that Lincoln Corbett, the acting police chief in Roséu and investigating officer Sergeant Allene, accusing him of illegal entry "is not the result of their independent judgment". Choksi alleged, "He did this at the behest of third party representatives of the Government of India." Seeking to quash the proceedings against him, Choksi told the High Court that the decision to accuse him of illegal entry was in violation of the law and consequently illegal, according to Dominica-based media organization 'Nature Isle News'. Choksi said that he is a citizen of Antigua and Barbuda where he has challenged his extradition move.
Mehul's claim- Forced entry into Dominica
He claimed that Indian people kidnapped him from Antigua and Barbuda and forcibly brought him to Dominica. Choksi claimed that he had reported his problems to the Dominica police but they did not investigate the allegations. Choksi said, "The arrest and prosecution of the applicant is an abuse of the process of the court as the police accusing the applicant is in connivance with his abductors and forced the petitioner to enter Dominica."
His lawyer told the magistrate court on Tuesday that he has filed a petition in the high court. Choksi has requested for a "permanent stay order on criminal charges" leveled against him for illegal entry. According to the news published on the website, he requested the court to order that the Minister of Immigration and National Security's declaration of him as an illegal immigrant violates the principles of natural justice and is illegal.
