Senior advocate Mukul Rohatgi, appearing for Ekta Kapoor , said a petition has been filed before the Patna High Court, but there is no hope that the matter will be listed for hearing soon. He said the apex court had earlier also given protection to Kapoor in a similar case. Rohatgi said the content of the series is subscription based and there is freedom of choice in this country. To this, the court asked what kind of option was being given to the people.

"Every time you come to this court...we don't appreciate it. We will fine you for filing such a petition. Mr. Rohatgi please convey this to your client. Just because you can take the services of a good lawyer... This court is not for those who have voice." The bench said, "This court works for those who do not have voice... The top court kept the matter pending and suggested that a local lawyer may be engaged to know about the status of the hearing in the high court. A court in Begusarai, Bihar had issued a warrant on the complaint of former soldier Shambhu Kumar. Kumar, in his 2020 complaint, alleged that the series 'XXX' (Season 2) showed several objectionable scenes involving the wife of a soldier.
