High court gave instructions regarding encroachment in Patna, encroached land should be vacated under any circumstances

The Patna High Court on Wednesday heard a public interest litigation filed regarding the illegal encroachments on the dam and Chant land of the main canal of Patna city.

The Patna High Court on Wednesday heard a public interest litigation filed regarding the illegal encroachments on the dam and Chant land of the main canal of Patna city. The court made oral remarks during the hearing and said that the encroachment on the government land will have to be removed under any circumstances. A division bench of High Court Chief Justice Sanjay Karol and Justice Partha Sarathi made the above remarks while hearing a public interest litigation filed by Raj Kishore Srivastava regarding encroachment in Patna.

Next hearing on December 5ย 

During the hearing in the court on Wednesday, their advocates appeared in the court on behalf of some encroachers. He demanded time from the court to hear the petition, which the court accepted and postponed the matter till the next hearing. The court has fixed the date of coming December 5 for the hearing. Earlier, the court had ordered the Circle Officer of Danapur to remove the encroachment and file an affidavit regarding compliance. The situation of encroachment on the land of dam and chant of the said canal has been accepted by the Circle Officer of Danapur in the court. The Circle Officer had himself told the court on May 5, 2022 that at least 70 percent of the encroachments would be removed in the next four weeks.

Son canal division wrote a letter to the circle officerย 

A letter was also written to the Circle Officer of Danapur for filing an encroachment suit by Son Nahar Division of Khagaul, but till now no action has been taken in this matter nor the encroachment has been removed. The list of encroachers has also been given to the Circle Officer of Danapur by the Executive Engineer of Son Canal Division. In his letter, the Executive Engineer had requested for concrete follow-up action by filing an encroachment case against the encroachers on the encroachment done on the land of departmental main canal dam and Chant so that the departmental land could be free from the encroachers.
