Rahul Gandhi's membership of Parliament has been terminated. The Surat court had sentenced him to two years' imprisonment only yesterday.

Rahul Gandhi's membership of Parliament has been terminated. The Surat court had sentenced him to two years' imprisonment only yesterday. A notification in this regard has been issued by the Lok Sabha Secretariat. Let us tell you that in the case of defamation, the court of Surat had sentenced Rahul Gandhi to two years imprisonment on Thursday itself. Rahul Gandhi was accused of controversial remarks regarding the Modi surname during the 2019 Lok Sabha elections. Against whom Gujarat BJP MLA Purnesh Modi had filed a defamation case against Rahul.

Notification issued by the Lok Sabha Secretariat

Notification has been issued. It states that Rahul Gandhi, Lok Sabha member from Wayanad, Kerala, is disqualified from the membership of the Lok Sabha after being convicted by the Court of Chief Judicial Magistrate, Surat. This disqualification will be applicable from the day of his conviction i.e. March 23, 2023. This decision has been taken under the provisions of Article 102 (1) (e) of the Constitution and Section 8 of the Representation of the People Act, 1951.

One copy each to Rahul Gandhi, President's Secretariat, Prime Minister's Secretariat, Rajya Sabha Secretariat, Election Commission, All Ministries and Departments of Central Government, Chief Electoral Officer, Kerala, Liaison Officer, Directorate of Estates, Parliament House Annexe, NDMC Secretary, Telecom Liaison Officer And has been sent to all the officers and branches of the Lok Sabha Secretariat. 

What is law?

If the MLA is sentenced to two or more years in any case, his membership will be cancelled. Also, he becomes ineligible to contest elections for six years. In such a situation, if Rahul Gandhi does not get relief from the upper court, then Rahul Gandhi will not be able to contest the 2024 Lok Sabha elections, which will be a big blow for him. 

What is the matter in which Rahul was sentenced?

Rahul Gandhi had said, how come the surname of all thieves is Modi? Regarding this, BJP MLA and former Gujarat minister Purnesh Modi had filed a defamation case against Rahul Gandhi. His allegation was that Rahul had brought down the dignity of the entire Modi community with his remarks. Rahul, a Lok Sabha member from Wayanad, had made comments related to the matter at a public meeting held in Kolar, Karnataka ahead of the 2019 general elections. How come the surname of all thieves is Modi? 

On Friday, after hearing the final arguments of both the sides, the date of March 23 was fixed for pronouncement of the verdict. Rahul appeared in the court thrice during the hearing of the case. In October 2021, Rahul, who reached the court to record his statement, declared himself innocent. Now Rahul has been sentenced in this case.
