The complaint alleges that Chief Minister Mamata Banerjee and Trinamool Congress MP Abhishek Banerjee have threatened to wrongfully detain BJP leaders in the state by calling for gherao of their residences.

At the TMC's July 21 mega rally in Kolkata, Abhishek Banerjee had called for a "peaceful gherao" of the houses of all booth-level BJP leaders from 10 am to 6 pm on August 5. At the same time, he demanded that the funds due to West Bengal be released by the central government led by the saffron party. Addressing a huge public meeting after some time, Chief Minister Mamata Banerjee said that this gherao should be from the block level leaders to the top level and the movement should be 100 meters away from their residences.

In the complaint made by email, the BJP MLA officer of Nandigram claimed that the TMC general secretary had called for the gherao, but the party supremo supported it during his speech. In an email to the officer-in-charge of Kolkata's Hare Street police station, the officer said, "BJP leaders have been threatened with wrongful confinement and wrongful detention by Abhishek Banerjee and Mamata Banerjee, knowing full well that it is completely illegal."

That day, Abhishek Banerjee also announced that he would go to Delhi on October 2 to protest with those who have been denied benefits under various welfare schemes.

Expressing apprehension that the call to gherao the residences of BJP leaders in the state may incite TMC supporters. Adhikari wrote in the July 22 complaint that this could adversely affect the life and safety of leaders of the saffron party, including him. The officer urged the police to treat the complaint as an FIR and initiate an investigation into the matter and take immediate steps to stop the spread of such speeches to ensure the safety and free movement of BJP leaders and workers.
