Supreme Court has given its verdict on the appointment of judges in lower courts, promotion for civil judge senior division will be increased from 10% to 25%.
Supreme Court on Tuesday has given its verdict on the appointment of judges in lower courts. The Supreme Court said in its decision that all the High Courts and states will amend the rules so that the 10 percent promotion through departmental examination for Civil Judge Senior Division is increased to 25 percent. Also, the Supreme Court has restored the requirement of minimum practice of 3 years to appear in the Civil Judge Junior Division examination. Apart from this, the state governments will amend the service rules for Civil Judge Senior Division and increase it to 25 percent.
The Supreme Court said in its order, 'All the state governments will amend the rules to ensure that any candidate appearing in the examination for Civil Judge Junior Division should have at least 3 years of practice experience. This should be certified by a lawyer having 10 years of experience in the bar.'
Apart from this, the time of work done as a law clerk for the judges will also be added. Also, after being selected as a judge, he will have to undergo one year of training before hearing in the court. The requirement of minimum practice will not apply where the High Courts have already started the appointment process of Civil Judge Junior Division.
With this, such recruitment processes, which were kept on hold due to the pending case, will now be done as per the revised rules. Earlier, the Supreme Court on Monday gave a historic verdict regarding the pension of retired High Court judges. The Supreme Court has ordered 'One Rank, One Pension' for retired judges from the High Court. This decision has been given by the bench of CJI Justice BR Gavai. The bench of CJI Justice BR Gavai said in its decision, 'Whatever be the source of their initial appointment, whether it is from the district judiciary or from among the lawyers, they should be given a minimum pension of Rs 13.65 lakh per year.
