USA Announces Successful Resolution to Labor Complaint Against Aludyne Automotive in Mexico

Almost two months after the Office of the United States Trade Representative (USTR) announced the first labor complaint of the Trump administration against Aludyne Automotive Mexico, the resolution against the company was released.

With this, the company Aludyne Automotive, specialized in auto parts, accepted an agreement to address a labor complaint it received through the Rapid Response Labor Mechanism of the Agreement between Mexico, the United States and Canada (USMCA).

The USTR stated that the company denied the right to freedom of association and collective bargaining to workers.

Therefore, the United States suspended the liquidation of tariffs on products from the Aludyne plant, which manufactures auto parts.

Given the complaint, the company, located in Mexico City, among the measures adopted by the facilities to address the matter include:

Reinstate and pay back pay and other benefits to a worker who was fired in retaliation for his union activity;

Adopt, disseminate, and implement a Charter of Neutrality statement and a Guidelines for Conduct policy on freedom of association and collective bargaining, which includes a zero-tolerance policy for violations of the right to freedom of association and collective bargaining;

Provide training to all company personnel on neutrality commitments and guidelines; Negotiate with the union and agree on policies that include rescheduling shop stewards to hours that allow workers better access to stewards and that union leaders have paid time to represent them during their workday.

The case against the company was initiated by the Union of Metal, Steel, Iron, Related and Similar Industry Workers (STIMAHCS), belonging to the Authentic Labor Front (FAT),who went to the North American authorities to address a conflict he had with Aludyne and which could not be resolved through Mexican labor laws and authorities.
