Vinay Sharma's lawyer AP Singh (AP Singh), one of the Nirbhaya Gangrape convicts, has now moved to the Election Commission. AP Singh said in a petition on Thursday that the Delhi Code of Conduct (Delhi election 2020) was in force at the time when Vinay was recommended to dismiss the application.
AP Singh has said in the petition filed in the Election Commission, 'The recommendation of the Delhi government to dismiss the mercy petition was not the MLA at that time (Manish Sisodia), because the model code of conduct was in force. There were elections in Delhi on 8 February. Nor was he on the portfolio of Home Minister of Delhi Government. Nor could he use that term.

AP Singh claimed, 'The letter recommending the dismissal of the mercy petition was signed with a screenshot of WhatsApp. This was done in a hurry. Let me tell you that Manish Sisodia was the Home Minister in Delhi Government and with his signature the recommendation to dismiss Vinay's mercy petition, was sent to President Ram Nath Kovind.
AP Singh has opposed the recommendation to dismiss the mercy petition. Significantly, on 1 February, Vinay's mercy petition was dismissed. Earlier, Vinay had argued in the Supreme Court that he had become mentally unwell due to 'alleged torture and abuse' in jail. However, his petition was rejected.
