ED has revealed that Amit Agarwal, arrested in the Rajiv Kumar cash case, has also been involved in illegal mining of Rs 1000 crore in Sahibganj. In the investigation, evidence has been found from Prem Prakash's companies of money laundering in Amit's companies. The ED said in the remand petition filed in the court of the special judge of PMLA on Saturday that Amit Aggarwal conspired with the police officers to harm the PIL running in the High Court as part of a well-planned conspiracy. He himself contacted advocate Rajiv Kumar through Sonu Agarwal and got him arrested by paying Rs 50 lakh.
Amit Agarwal on ED remand for seven days
Amit Aggarwal's aim in this entire episode was to avoid money laundering case by harming the PIL. After the hearing, the court of Justice Dinesh Rai, in-charge of the ED court, allowed the accused Amit Kumar Agrawal to be on ED remand for seven days. However, the ED had sought a remand of 14 days. The period of remand will be from October 15 to October 15. Earlier, the court had ordered to send the accused to judicial custody till October 14.
Birsa Munda sent to Amit Agarwal Central Jail
On the order of the court, Amit Agarwal has been sent to Birsa Munda Central Jail. ED conducted a health check-up of Kolkata businessman Amit Agarwal on Saturday before questioning. In this, the level of blood pressure was found to be 151/91, which was above normal. The ED has told the court that Amit Aggarwal was apprehensive of the High Court ordering a probe into the shell companies case. Hence a conspiracy was hatched by him to evade investigation. Lawyer Rajiv Kumar got trapped due to greed and was caught taking Rs 50 lakh.
PC Act imposed in the complaint
Amit had withdrawn Rs 60 lakh from his bank to give to Rajiv Kumar, out of which Rs 50 lakh was handed over to Rajiv Kumar. Under the conspiracy hatched by Amit Agarwal, Kolkata Police imposed PC Act (Prevention of Corruption Act) in the complaint made by him. It was alleged by Amit Aggarwal for the purpose of imposing the PC Act, that Rajiv Kumar had assured the authorities to slow down the matter by taking Rs 10 crore. ED probing this point found that neither any government official nor any investigative agency had contacted Rajiv Kumar or Shivshankar Sharma.
The reason given for Amit Agarwal being more guilty
The ED, citing some judicial orders, said that bribes are taken in two ways. In the first method, one person takes bribe by intimidating the other. In this, the person taking bribe by intimidation is considered more guilty. In this, the intimidator has a personal interest. In another way, a person himself contacts another and offers to bribe him. In this second method, the person giving bribe by contacting himself is more guilty. The case of Amit Agarwal and Rajeev Kumar is different, so Amit Aggarwal is more guilty.
ED may interrogate some more people
The ED team may interrogate some more people in the money laundering case related to illegal mining. In this, there may be people related to the arrested businessman Amit Agarwal. At the same time, people running boats (ferries) in Sahibganj can also be questioned. Some people may even be arrested.
File a complaint after committing a crime
After producing the accused Amit Kumar Agrawal in the court at 2.15 pm on Saturday, the ED sought remand for 14 days. During the hearing of the case, the court was told on behalf of the accused that he is the complainant in the case in which the ED has arrested him. He had lodged an FIR, but ED has made him an accused. On this, the court said orally that if a person files a complaint after committing a crime, can he not be an accused. The court was told on behalf of the ED that Amit Agarwal's remand is needed for further investigation in the case.
Amit Agarwal was in touch with the officers
From the CDR (Call Detail Report) of Amit Agarwal's mobile, ED has come to know that he used to have conversations with about a dozen top officers. There were constant talks with two or four officers. Earlier also these things were coming to the fore that like Prem Prakash, Amit Aggarwal also had contacts with the top officials of the state. Whenever Agarwal was in Ranchi, officers used to meet him. Only after this, the CDR of all his mobiles was extracted, due to which many information got to ED.
