The Rayito de Sol Early Learning Center, in north Chicago, became the center of attention after agents from Immigration and Customs Enforcement (ICE) raided the building to arrest a worker with a pending asylum case and a valid work permit. The scene, which unfolded in front of children and educators, left staff stunned and the community in shock. The arrest was captured on video and shared on social media by journalist Tahman Bradley. The footage shows the woman, later identified as Diana Patricia Santillana Galeano, pleading with the officers, reminding them that she “has papers.” The arrested woman and conflicting accounts: According to Newsweek, hours after the operation, the Department of Homeland Security (DHS) identified the detainee as Diana Patricia Santillana Galeano, a 39-year-old Colombian citizen. According to the agency, Santillana was located by the Border Patrol on June 26, 2023, after illegally crossing the southern border, and subsequently released into the United States under federal supervision. The DHS maintains that the woman attempted to bring her teenage children into the country through smugglers, and that the arrest occurred after she fled a traffic stop in Chicago. However, witnesses claim that agents followed her to the daycare center and arrested her inside the building, contradicting the official version. “They took her out in handcuffs in front of the children,” a teacher reported. Tricia McLaughlin, a DHS spokesperson, told Newsweek that the arrest occurred “in a lobby” and not in a classroom, and that the woman “lied about her identity.” However, images released by local media show the officers inside the school, reinforcing allegations of a possible violation of "sensitive locations" policies.

Political Reactions and Calls for Accountability

The case generated a strong response from officials and local leaders. Democratic Congressman Mike Quigley, representing Illinois,She accused ICE of entering the school without a warrant. “No teacher should have to explain to children why their teacher was dragged away in front of them,” she declared at a press conference. Meanwhile, Congresswoman Delia Ramirez, of Illinois' 3rd District, called in Washington for Congress to investigate the tactics employed by DHS and to limit the use of face coverings by agents. “This is not just a violation of rights, it is an example of how immigration policies continue to criminalize the daily lives of immigrants,” she stated. A parent at the school described the incident as an act of “domestic terrorism.” “She had the right to live and work in this country. If this happens in Chicago, it can happen in any other community,” she said during a vigil in front of the school. The debate over “sensitive locations” and immigration policy. Guidelines issued by the federal government in 2021 state that schools, places of worship, and hospitals should be considered “safe zones,” where immigration detentions are prohibited except in exceptional circumstances.

Lawyers and organizations such as the Illinois Coalition for Immigrant and Refugee Rights (ICIRR) demanded an independent investigation, arguing that ICE flagrantly violated these regulations.

DHS defended its actions, stating that the work permit granted to Santillana was used “as a loophole to facilitate the invasion of our country,” a statement that was harshly criticized by civil rights groups for its stigmatizing tone.

The immigrant community has organized demonstrations in support of Santillana and called on the federal government to review detention protocols in public spaces. “We want accountability, not justifications,” said Congresswoman Ramirez. Meanwhile, the case remains under review by the Department of Homeland Security, which has not yet confirmed whether it will file additional charges against the woman.
