The Eknath Shinde faction has got a big victory from the Supreme Court on the real Shiv Sena issue. While the Uddhav Thackeray faction has suffered a setback. The Supreme Court has rejected the application of Uddhav Thackeray and refused to stay the action of the Election Commission. The Supreme Court has allowed the Election Commission to take a decision on this issue.

Shiv Sena President Uddhav Thackeray had expressed confidence that he would get relief from the Supreme Court, but nothing like this happened. He has suffered a crushing defeat in a legal battle with the rebel camp led by Chief Minister Eknath Shinde.

The Supreme Court had on August 23 referred the petitions filed by Shiv Sena and Maharashtra Chief Minister Eknath Shinde to a five-judge Constitution Bench. In which many constitutional questions related to defection, merger and disqualification were raised.

In fact, Chief Minister Eknath Shinde had called his faction the real Shiv Sena. After which Uddhav Thackeray had applied in the Supreme Court to stop the Election Commission from taking a decision on the Shinde faction's claim in the original Shiv Sena case.

It is known that in June this year, Eknath Shinde and 39 other MLAs revolted against the Shiv Sena leadership, after which the Uddhav Thackeray-led Maha Vikas Aghadi government fell. Shinde spent many days in Gujarat and Guwahati with his supporting MLAs, then returned to Maharashtra to form a new government with the Bharatiya Janata Party. In which Devendra Fadnavis took oath as Deputy Chief Minister and Shinde as Chief Minister on June 30.

Uddhav Thackeray had said that the MLAs of the Eknath Shinde faction can save themselves from disqualification under the 10th Schedule of the Constitution by merging with another party. Whereas the Shinde faction had said that the anti-defection law was no basis for those leaders who have already lost the confidence of the party.
