Federal judge permanently blocks deployment of the National Guard in Portland

District Judge Karin Immergut definitively blocked President Donald Trump from sending the National Guard to Portland by issuing her final order on Friday.
The case centered on whether the protests taking place outside the Immigration and Customs Enforcement (ICE) building in the city justified the deployment of the Guard National.
In her ruling, the judge acknowledged that “there were indeed violent protests in June,” but that law enforcement was able to control them.
“Since that brief period of a few days in June, the protests outside the ICE facility in Portland have been predominantly peaceful, with only isolated and sporadic incidents of low-intensity violence, mainly between and against protesters,” the judge wrote in his 106-page order. “This Court concludes that, while respecting the President's decision, he had no legal basis to federalize the National Guard.”
The permanent court order took effect immediately.
Judge Immergut ruled that the president exceeded his authority by attempting to mobilize state and federal troops to respond to protests against Border Patrol agents in Portland.
“This case is about whether we are a nation of constitutional law or martial law,” city attorney Caroline Turco said at the hearing, according to local television reports.
The judge had issued two temporary orders earlier this month: one preventing Trump from deploying the Oregon National Guard and a broader one blocking the deployment of forces from other states, such as California or Texas.
With Friday's decision, those measures became permanent, although the White House anticipated that it will appeal the ruling, which could reach the Supreme Court.
The government Trump argued that he was acting to “protect federal assets and personnel following violent riots,”While local authorities maintain that the violence was limited and controlled by the Portland police.
Since August, Trump has sent thousands of National Guard troops, as well as hundreds of agents from various federal agencies,to cities governed by Democratic authorities, such as Chicago, under the justification of “out-of-control crime” and prioritizing raids against undocumented immigrants, generating confrontations and mass demonstrations.
