The Supreme Court has adjourned the hearing of the Cricket Board of India's ( BCCI ) plea seeking amendments to the constitution with regard to the tenure of its office bearers, including president Sourav Ganguly and secretary Jay Shah.
Harish Salve had sought adjournment of the hearing
A bench of Chief Justice NV Ramana and Justices Krishna Murari and Hima Kohli adjourned the matter for Thursday after senior advocate Harish Salve, appearing for the BCCI, sought adjournment of the hearing. The counsel appearing for the Bihar Cricket Association said that the office-bearers are continuing their term while technically their term is over.
BCCI wants an amendment to the constitution
The BCCI is seeking approval to amend its constitution with regard to the tenure of its office bearers. Senior advocate PS Patwalia, appearing for the BCCI, submitted that their application was filed two years ago and two weeks later the court had directed the matter to be listed. Patwalia said, but then the Covid (pandemic) came and the matter could not be listed. Please list this matter for emergency hearing as the amendment to the constitution is awaited for two years. Patwalia said that in the earlier order of the court, it was said that amendment in the constitution can be done only after the approval of the court.
According to the Lodha committee, after the tenure of 6 years, the office bearers will have to take a break of 3 years
Earlier, a committee headed by Justice RM Lodha had recommended reformative steps in BCCI, which was accepted by the apex court. As per the recommendations, the office-bearers at the state cricket association or BCCI level will have to go through a three-year break after a tenure of six years.
BCCI demands removal of break time for office-bearers
The BCCI, in its proposed amendment, has sought approval to do away with the break time for its office-bearers so that BCCI President Ganguly and Secretary Shah can continue in their posts even after completing six years in the respective state cricket associations. As per the Constitution of BCCI approved by the Supreme Court, if an office-bearer completes two consecutive terms of three years in the State Cricket Association or BCCI, he will have to take a mandatory break of three years. Ganguly was an office-bearer in the Cricket Association of Bengal while Shah was an office-bearer in the Gujarat Cricket Association.
