A bit like digital "telephone": it follows the thread, but adds fantasies until the final version sounds real, even if it's totally false. And that's a key problem when these "answers" are presented as reliable information.
Google faces lawsuit over digital hallucination
The controversy arose when Wolf River Electric, a solar panel company in Minnesota, filed a defamation lawsuit against Google. The reason? Its AI, through the AI ?Overviews feature, confidently stated that the company had been sued by the Minnesota attorney general for "deceptive practices." Note: That lawsuit never existed.
The AI ?didn't stop there: it mentioned four executive names (Justin Nielsen, Vladimir Marchenko, Luka Bozek, and Jonathan Latcham), showed a photo, and even cited links three news stories and an official statement that supposedly supported the claim, but none of them mentioned Wolf River Electric in any legal context.
According to the company, this was no joke: contracts totaling up to $150,000 were canceled, customers became distrustful, and its reputation was damaged. The main complaint: the “hallucination” wasn't innocent; it was very serious and had real consequences.
Google, for its part, admits that most AI Overviews are useful, but acknowledges that errors can occur. They immediately removed that response and now face a defamation lawsuit, opening an unprecedented legal debate.
Why is this a turning point for Google?
What happened with Wolf River Electric represents a break in the way we understand Google's role in the age of artificial intelligence. Until now, The tech giant had always argued that it only displayed content created by third parties, functioning as a neutral intermediary. But with the introduction of AI-generated responses, such as those in AI Overviews, Google is moving from being a search engine to becoming a content generator, which entails a new ethical and legal responsibility.
If the information presented comes directly from an artificial intelligence trained by the company itself, one can no longer speak of neutrality. Google becomes the publisher of what it displays, and that forces it to respond if the content is false, misleading, or defamatory. The Wolf River Electric case demonstrates how serious this can be: the AI ??not only invented a nonexistent lawsuit, it also provided names, images, and seemingly credible sources. This is not a simple technical error; it is a structural failure with a direct impact on real people and their businesses.
The incident also challenges the legal foundations on which Google has protected itself for years. Regulations like Section 230 in the United States protected platforms from other people's content, but that argument collapses when the information is created by the company itself using AI. That's why lawyers and technology experts insist this is a defining moment that requires creating new rules, requiring external audits, and ensuring transparency in how these models are trained and tuned.
Although Google reacted quickly, removing the response and adding warnings, the "experimental" label is no longer enough. Tech companies must accept that their influence goes beyond experimentation: if their systems generate errors that destroy the reputations of third parties, they must assume responsibility. What's at stake is not just the reputation of a product, but global trust in the company that manages the gateway to digital information.
