Judge grants freedom to Kilmar Abrego García, a Salvadoran who had been deported in error
Kilmar Abrego Garcia will regain his freedom, but without being in ICE custody
Waverly D. Crenshaw, a district judge in Nashville, Tennessee, granted freedom to Kilmar Abrego García, a Salvadoran who, in March, He had been deported from the United States by mistake.
After more than 14 years of living in the United States and despite having a court order prohibiting his deportation, Abrego García was sent to his native country to be locked up in a maximum security prison.
The 29-year-old man was accused of belonging to the Mara Salvatrucha (MS-13), a criminal group considered by the United States government to be a terrorist organization.
The defendants have done little to assure the Court that, absent intervention, Abrego Garcia's due process rights will be protected,†he said.
The judge's order contradicts the threat issued by the Department of Homeland Security to arrest Abrego Garcia with the goal of, hours later, deporting him to a third country.
In this regard, Tricia McLaughlin, spokeswoman for the Department of Homeland Security,He called the judge who ordered the Central American immigrant's release insane.
"The fact that this insane judge is trying to tell ICE that they can't arrest someone who is subject to immigration detention under federal law is insane," he said.
