The dispute between several states and the administration of President Donald Trump over the management of resources intended for emergencies reached the courts. A coalition of 25 states and the District of Columbia sued the Federal Emergency Management Agency (FEMA) and the Department of Homeland Security (DHS), accusing them of using federal funds as a way to pressure state governments to adopt policies on elections and immigration.

According to information from CBS News, the plaintiffs maintain that FEMA could withhold around $148 million corresponding to the Homeland Security Grant Program, in addition to canceling future support if states do not comply with the new conditions established by the federal administration.

Among the challenged requirements are verifying voters' citizenship through a federal database, implementing changes to election processes and greater cooperation with immigration authorities. The states argue that these demands are unrelated to the funded programs, which aim to strengthen disaster response, national security, cybersecurity, and emergency services.

FEMA defends new rules

Rhode Island Attorney General Peter F. Neronha, who is leading the lawsuit, said the Trump administration is “threatening to jeopardize public safety by illegally withholding billions of dollars in crucial funds.”

Furthermore, he maintained that “Congress assigned these funds to the states for emergency preparedness and response (…) and the executive branch has no legal interference in the matter.”

In response, a FEMA spokesperson declared to the aforementioned media that the measures seek to strengthen electoral integrity and protect American democracy. However, the states maintain that the new conditions violate the Administrative Procedure Law and the Expenditure Clause of the Constitution, which is why they asked a federal judge to block their application and order the release of the resources.
