The NIA originally started the investigation on the basis of a case registered on August 20 at Matia police station in Assam's Goalpara district. The NIA re-registered the case on September 26 this year under charges of sections 18, 18B, 19 and 20, 120B, 121 and 121A of the Indian Penal Code (IPC) of the Unlawful Activities (Prevention) Act.

Registering the case, the NIA started investigation following an order received on September 23 from the Counter Terrorism and Counter Radicalization (CTCR) in the Ministry of Home Affairs (MHA). The investigating agency came to know that Jalaluddin Shaikh, 49, resident of Gopalpur Tilpara village, Abdus Subhan, 43, resident of Rakhyasini village in Goalpara district, and others were involved in prohibited activities of waging war against the Union of India by luring the minds of various others.
