The Allahabad High Court has stayed his arrest while granting interim relief to Ganesh Dutt Mishra, a close aide of Mukhtar Ansari, in connection with the deed of land. The court has said that the petitioner will not be arrested till the next date of hearing of the case or till the police report is filed. This order was given by Justice Mahesh Chandra Tripathi and Justice Narendra Kumar Johri while hearing the application of Ganesh Dutt Mishra.

In the court, advocate Upendra Upadhyay argued that the matter is of civil nature. But, on November 3, 2020, an FIR is being lodged against the petitioner at the Kotwali police station of Ghazipur district. Whereas, the deed was done in 2009 and the name of the opposition plaintiff Sue Kanti Pandey has been registered in the revenue records. Plaintiff Sue has not filed any civil suit in this matter till date. Therefore, the FIR registered in the matter should be quashed. The advocate also cited Randhir Singh vs. State of UP and other cases of the Supreme Court in this regard.

After hearing the arguments of the petitioner, the court has directed all the other respondents including the opposition Kanti Pandey to file their reply. In this case, Kanti Pandey lodged an FIR against the petitioner Ganesh Dutt Mishra in the Kotwali police station of Ghazipur, saying that the land he had dealt with for sale was not on the spot. He came to know about it after getting the bond. When he lodged an FIR in this case, the petitioner is threatening him and demanding five lakh rupees.
