There was a hearing again in the Supreme Court regarding caste enumeration today. The Central Government has filed an affidavit in the Supreme Court regarding the caste census. In this, the government has said that the states do not have the right to conduct the census. Earlier, the hearing was held on 21 August. In this, the court had heard the petitions demanding a ban on caste enumeration. Solicitor General Tushar Mehta had sought 7 days time from the court of Justice Sanjeev Khanna and Justice Bhatti. After this, the date of 28 August was given.
Earlier in the court, the Bihar government argued that the survey work has been completed in the state. All the data has also been uploaded online. After this, a demand was made on behalf of the petitioner to release the data. Now the court will hear the matter again on Monday.
NGO filed a petition against the High Court's decision
According to the cause list uploaded on the apex court's website, the court will hear the petition filed by NGO "Ek Soch Ek Prayas Ki" against the High Court verdict. Apart from the NGO, another petition was filed in the Supreme Court against the High Court's decision. The petition, filed by Akhilesh Kumar, a resident of Nalanda, Bihar, argued that the notification issued by the state government to conduct the caste census was against the provisions of the Constitution. According to the provisions of the constitution, only the central government has the right to conduct the census.
Patna High Court gave the green signal to the Bihar government on August 1
In fact, the Patna High Court had heard the questions arising regarding the caste census in Bihar. A division bench of Chief Justice Vinod Chandran and Justice Partha Sarthi heard the arguments of the petitioner and the Bihar government for five consecutive days (from July 3 to July 7). The court heard the arguments of both sides. After this, on August 1, the Patna High Court gave the green signal to CM Nitish Kumar's dream project. The Patna High Court had given permission to conduct it like a survey. After this, the Bihar government resumed the work of enumeration in the remaining areas. According to the Bihar government, the work of caste-based enumeration has been completed.
