Fugitive diamond merchant Nirav Modi has received a blow from the Supreme Court of Britain against the decision to extradite him to India. Nirav Modi UK High Court has rejected his appeal. The High Court in London refused to allow Nirav Modi to file an appeal against his extradition order in the UK Supreme Court, rejecting the fugitive businessman's plea.
"The appellant's (Nirav Modi) application for leave to appeal to the Supreme Court is refused", Lord Justice Jeremy Stuart-Smith and Justice Robert Jay ruled on Thursday at the Royal Courts of Justice in London.
Last month, on November 9, the High Court in London gave its decision to extradite Nirav Modi to India. However, by filing another petition in the High Court, he sought to file a petition against his extradition in the Supreme Court of Britain. Today the High Court of London has given its verdict on this same appeal. Prior to that, in February last year, a Westminster judge had ordered his extradition to India. However, he was later allowed to appeal against the decision. India has been trying for a long time to bring Nirav Modi to India. But Nirav Modi, who is lodged in UK jail, is giving different arguments to stop his extradition.
His lawyers in the UK had earlier argued that the fugitive economic offender is a victim of depression. He can commit suicide in the jails of India. Giving this argument, he opposed sending Nirav Modi to India. However, the UK court rejected his petition after a full hearing. Earlier, during the hearing in the case, Justice Robert J had emphasized that India has good relations with Britain. In such a situation, it is necessary for Britain to respect the India-UK Extradition Treaty of 1992.
Nirav Modi was declared a fugitive economic offender as per the Fugitive Economic Offenders Act, 2018 by the special PMLA court in December 2019. After which he fled to London. Three years ago, Nirav Modi was arrested by Scotland Yard Police of Britain from London on 13 March 2019, after which he is imprisoned in Wandsworth Jail in South West London.
