The Supreme Court has issued notices to the Center and Attorney General R Venkataramani today i.e. on Friday on two petitions by same-sex couples. A bench of Supreme Court Chief Justice Justice DY Chandrachud and Justice Hima Kohli considered the representation filed by senior advocate Mukul Rohatgi before issuing the notice.
Two gay couples had appealed: The bench has sought a reply on the notice in four weeks. At the same time, the Central Government and the Attorney General of India have also been directed to issue notices. Significantly, in their appeal, two same-sex couples have sought a direction to recognize their marriage under the Special Marriage Act. One petition has been filed by Supriyo Chakraborty and Abhay Dang, a gay couple living in Hyderabad, while the second petition has been filed on behalf of gay couple Partha Firoz Mehrotra and Uday Raj.
Violation of the Article of the Constitution for not giving recognition: Significantly, in their petition, both have sought directions to give LGBTQ (Lesbian, Gay, Bisexual and Transgender and Queer) community people the right to marry the person of their choice. The request was made. It has been said in the petition that not recognizing gay marriage is a violation of the right to equality and the right to life under Articles 14 and 21 of the Constitution.
A five-judge constitution bench of the Supreme Court in 2018 unanimously decriminalized part of the 158-year-old colonial law under Section 377 of the Indian Penal Code, which made "consensual unnatural sex an offence".
