ICE arrests a Mexican immigrant and her lawyers say she has citizenship: details of the case
A young woman detained by ICE faces a legal dispute: her lawyers claim she is a U.S. citizen, while DHS maintains she is not
A young woman identified as Dulce Consuelo Diaz Morales, 22, was arrested on December 14 in Baltimore, Maryland, by ICE agents.
However, her detention has generated opposing statements: while her lawyers maintain that she has U.S. citizenship, The Department of Homeland Security (DHS) asserts that she is an immigrant who entered the country without the documentation to reside legally. The DHS added that Dulce has a current deportation order. On the day of her arrest, the young woman was returning home with her sister when she was approached by uniformed officers. Although she claimed to have been born in the United States, she could not prove her citizenship at the time, so she was taken into custody, Newsweek reported. And despite her lawyers obtaining a court order for her to remain in Maryland, the DHS transferred her to a detention center in Louisiana. Since then, her legal representatives say they have been unable to contact her or confirm her current whereabouts.
What her lawyers and DHS say about the detained immigrant
In statements to the media, Perez maintained: “There is law here. There is written law. There are systems and circumstances of mandatory detention, but this is not one of them.”
According to the defense, Diaz Morales has no criminal record nor does she face additional criminal charges that would justify her transfer or detention. Furthermore, they point out that a federal district judge, Brendan Hurson, ruled that she could not be deported while her legal situation was being resolved.
The federal government's version is different. DHS Deputy Secretary Tricia McLaughlin publicly stated that the young woman is not a U.S. citizen and is subject to a deportation order. In a statement sent to Newsweek,He stated: “Dulce Consuelo Madrigal Diaz is NOT a U.S. citizen; she is an illegal immigrant from Mexico.” According to DHS, when she was found by CBP near Lukeville, Arizona, on October 20, 2023, the young woman allegedly claimed to be a Mexican citizen and to have been born on October 18, 2003.
