In the case of misbehavior done by SHO and SI by entering the chamber of Madhubani Civil Court ADJ Avinash Kumar (1st), the High Court has made very strict comments on registering an FIR against the ADJ itself. The High Court has said that along with the DGP of Bihar, the concerned SP and IO should be presented in the court on Thursday. The angry court said that we will decide tomorrow whether to send him behind the bars or not.
Madhubani SP summoned with DGP
A division bench of Justice Rajan Gupta and Justice Mohit Kumar Shah said these things on Wednesday while hearing the report sent by the Madhubani District Judge to the High Court. The court asked the public prosecutor that under which provision this FIR has been registered on behalf of the person who humiliated the judicial officer. Whereas, even the Supreme Court does not allow this. On this the public prosecutor could not give any answer. The court has ordered to present Madhubani's SP and the research officer of this case along with the DGP in the court at 2.30 pm on Thursday.
High Court is monitoring this matter
It is known that the High Court is monitoring the matter. Advocate Mrigank Mouli, present in the court, told the bench that many high courts of the country, including the Supreme Court, have clearly ordered that an FIR can be lodged against a judicial officer only when the Chief Justice of the High Court gives its approval. No approval was taken from the Chief Justice. The lawyer representing the Bihar Police said that a letter was written to the Chief Justice for the FIR.
