At present, about one lakh 40 thousand employment-based green cards are issued every year under the immigration law.

The Department of Homeland Security (DHS) is tasked by Congress with issuing family and employment-based immigrant visas each year. A number of these visas have been fixed. To deal with this, Bhutoria has proposed two solutions in his recommendation
First, the Department of Homeland Security and the Department of State should reallocate unused green cards for household and employment categories from 1992 to 2025. From 1992 to 2022, more than two lakh thirty thousand green cards could not be used. These should be obtained and put into practice again. This can be used by gradually increasing the annual quota.
Second, the State Department, in cooperation with the Department of Homeland Security, should adopt a new policy to confirm that all green cards according to the annual limit remain available to eligible immigrants, even if the agencies cannot process paperwork in that fiscal year.
He added that this policy should be implemented retroactively to reclaim unused green cards before the new policy came into force.
