The trial of the nurse accused of Diego Armando Maradona's death, Gisela Dahiana Madrid, who was to be tried separately from the rest of the defendants, was suspended this Thursday, following a request filed by the lawyers of the star's daughters to declare it void, until the scope of the annulment of the first is determined. process.

Nurse Madrid had requested a jury trial, for which reason she was going to be tried in a process parallel to that of the other seven health workers accused of simple homicide with eventual intent for the death of Maradona.

This Thursday, during one of the preliminary hearings of the trial against the nurse, the lawyers of Dalma and Gianinna Maradona raised the request for the nullity of the process, which was supported by the Prosecutor's Office and the rest of the plaintiffs.

Judge María Coelho finally ordered "the suspension of the preliminary hearing until the scope of the nullity of the other trial is determined" against seven health workers.

That other process had begun on March 11 in the Oral Correctional Court (TOC) No. 3, but was declared null on May 29 after the scandal unleashed by the participation of one of the judges, Julieta Makintach, in a documentary about the procedure judicial.

“What we are proposing is that since everything that happened in the TOC Nº 3 was annulled, this also causes the nullity of the separation process of the case. This case arises from an act that was declared null,” argued Fabian Amendola, one of the lawyers for Dalma and Gianinna Maradona.

By declaring the nullity of the trial carried out by TOC Nº 3, it was decided to return the process to the instances prior to the incorporation of Judge Makintach.

Given that the decision to try the nurse in a parallel process was made in a later instance, according to the lawyers, that decision is invalid.

“We do not want to submit to a process that has a cause for nullity. Any colleague can argue that this trial was null and void and can raise it after it has concluded. Even in the event of a conviction, They would have the possibility of annulling everything that had been done due to the way in which this process was generated," continued Amendola.

The one who will have to determine to what extent the trial of the seven defendants should be retroactive, in order to understand whether the nullity affects or not the decision to judge Nurse Madrid in a separate trial, is the TOC Nº 7, the court that last month was chosen by lot to begin a new process.
