Dua Lipa sues Samsung for unauthorized use of her image
The British singer accuses the technology company of exploiting her photography in television packaging and demands $15 million
Well-known artist Dua Lipa, 30 years old, filed a multi-million dollar lawsuit against Samsung Electronics, demanding $15 million for indigenous use based on his image. According to information published by Variety, the lawsuit was filed on Friday May 8 in the Central District of California.
What caused the legal dispute?
According to the legal document, the electronic products manufacturer used a photograph of Dua Lipa during her performance in the festival Austin City Limits to illustrate the packaging of its televisions, a practice that would have been spread from last year.
The interpreter of “Levitating” affirms that, as soon as she became aware of the fact, she requested Samsung to cease the use of her image. However, the company would have acted in an “indifferent and insensitive” manner by rejecting said request.
The lawsuit claims that Dua Lipa's image was used “prominently in a mass marketing campaign for a consumer product without her knowledge, without consideration and without her having a voice, vote, control,or any influence.”
The text adds in a forceful manner: “Ms. Lipa did not authorize nor would have authorized this use.”
The artist alleges that Samsung has financially benefited from a photograph whose copyright belongs to it. To support this claim, the lawsuit includes ca pictures of several publications on the social network X (formerly Twitter), where users directly attribute their decision to buy a television to the image of Dua Lipa.
The brand Dua Lipa
The singer's legal team emphasizes that Dua Lipa has carefully cultivated a “prestige brand” and that is “very selective” when when choosing products s that it promotes. Therefore, the unauthorized use of your image not only violates your economic rights, also the control over your identity and commercial reputation.
According to what is reviewed by Variety, the lawsuit filed includes multiple legal causes: a violation of copyright rights, a violation of the law on own image gen of the state of California, a claim under the Lanham Act (which protects registered trademarks at the federal level) and additional trademark claims.
As of now, Samsung has not issued an official statement responding to these allegations.
