Both the factions have staked their claim on Shiv Sena and have also declared the election symbol as their own.

Shinde and Uddhav factions cannot use Shiv Sena's election symbol at present
The Election Commission has barred the Thackeray and Shinde factions from using the party's name and its symbol. After which Eknath Shinde and Uddhav Thackeray faction cannot use its election symbol at the moment.
For the by-election, both the groups will get different election symbols
The Election Commission has asked for new election symbols from both the groups for the by-election, so that both the factions can enter the fray in the by-election. In the interim decision, the Election Commission said that both the Shiv Sena factions can choose new names in the Maharashtra by-elections, they will be allotted election symbols. Both the parties have been asked to present free election symbols by 1 pm on October 10.
