Undocumented parents with children born in the US urged to get passports
Immigration lawyer urges parents to get their children US passports so they can return without problems
If you are thinking of returning to your country of origin and taking your children born in the United States with you, don't forget to get them their US passports; and, if possible, dual citizenship.
“A US citizen was detained for almost a month for a mistake many parents make: she took her daughter to live in Mexico without first obtaining a US passport for her, and while there, she easily obtained a Mexican birth certificate,” recounted attorney Alex Galvez.
He noted that when the mother returned, she presented her daughter's US birth certificate, but immigration officials realized she also had another birth certificate as a Mexican citizen.
“The result was that she was detained for 28 days,” he said.
The immigration expert's recommendation to parents is that if they can no longer toughen the pressure from Trump and plan to return to their countries, they should make sure to obtain US passports for their children before doing so to avoid problems when they want to return.
“The inability to locate the father for acknowledgment, as well as the lack of a marriage certificate for his parents, had presented an obstacle. Thanks to the birth registration, they now have a document that recognizes their Mexican nationality and opens the door to the full exercise of their rights,” explained the Consulate.
Birth registration allows for the recognition in Mexico of a birth that occurred abroad, which involves transcribing the contents of a US birth certificate onto a Mexican birth certificate, provided that it is proven that one of the parents is Mexican.
The consulate announced that the new registration process is largely a result of the simplification of requirements and procedures promoted by the Ministry of Foreign Affairs and the Digital Transformation and Telecommunications Agency, with the aim of streamlining processes, standardizing criteria, and, above all, improving the well-being and experience of users at consular offices.
“One of the things I had dreamed of since “What I wanted as a child was to connect with my father's side of the family and have a sense of culture. And today, my dream has finally come true,” said Jonathan Picos. “Honestly, the process was smoother than I expected, and it happened in a couple of weeks.”And everyone was very hospitable,” he added. The Consulate General of Mexico in Los Angeles announced in a statement that they issued the first birth certificate through the registration process, which is a significant step forward in guaranteeing the right to Mexican citizenship for descendants of Mexican fathers or mothers. “The birth certificate issued through the registration process, Previously, this could only be done at the civil registry in Mexico; and this procedure applies when the Mexican father is not on record and there is no marriage certificate for the parents,” explained a spokesperson for the Mexican Consulate in Los Angeles. The first birth certificates issued through this registration process were for brothers Jonathan Alonso and Joseph Concepcion Picos, who had been trying for years to obtain their Mexican birth certificates.
