Human rights advocates sue DHS over abuses committed against immigrants
The Advocates for Human Rights, Democracy Forward, and a group of individuals filed a lawsuit against the Department of Homeland Security
Department of Homeland Security (DHS) access to legal counsel but also... lacking legal status, they are detained, but rather locked up in unsanitary facilities where their food is restricted and they are subjected to overcrowded conditions.
The lawsuit states that DHS and Immigration and Customs Enforcement (ICE) officers, as well as security personnel, transfer some detainees out of Minnesota and exerted constant pressure on them to waive their rights by signing their deportation orders without first having access to a lawyer to advise them on what to do to secure their release.
In this regard, Skye Perryman, president and CEO of Democracy Forward, another of the plaintiff organizations, issued a statement rejecting the position taken by the federal government to intimidate people detained for deportation purposes.
“The Trump-Vance administration continues to resort to a form of 'catch-me-if-you-can' justice that is harmful and unlawful. The facts outlined in our lawsuit describes a system “Inhumane practices designed to strip people of their legal rights, traumatize them, isolate them from their lawyers, and rush them through detention and transfer before they can access legal counsel," the text states. The lawsuit seeks the Court's immediate intervention to restore access to justice, demand confidentiality in attorney-client communications, and end obstructive and retaliatory practices that block legal representation. "They are detaining people in federal facilities that were never intended for long-term custody, denying them access to lawyers, "Shackling them during secret transfers and using fear and exhaustion to pressure them into waiving their rights. This is a deliberate strategy to evade accountability and violates the Constitution and federal law. Access to legal counsel is a fundamental right in the United States,” Skye Perryman emphasized.
