Two weeks after a judge invalidated a law that allowed Texas college students to pay tuition at the same rate as in-state residents, the Justice Department is now targeting Kentucky.

According to official information, the DOJ filed a lawsuit in the Eastern District of Kentucky, claiming that the law “unconstitutionally discriminates against American citizens, who are not afforded the same privilege, in direct conflict with federal law,” as it grants reduced tuition to undocumented immigrants.

This challenge builds on a recent, successful lawsuit against the state of Texas over a similar law," the agency stated.

“No state can be allowed to treat Americans as second-class citizens in their own country by offering financial benefits to undocumented immigrants,” stated Attorney General Pamela Bondi.

“The Department of Justice just won in this very case in Texas, and we look forward to fighting in Kentucky to protect the rights of American citizens,” she continued.

In the lawsuit, the United States seeks to join enforcement of a Kentucky regulation requiring public universities to offer reduced in-state tuition rates to undocumented immigrants considered Kentucky residents.

Federal law prohibits public institutions of higher education from offering undocumented immigrants benefits not available to US citizens. This regulation, according to the Trump administration, blatantly contradicts federal law and is therefore unconstitutional under the Supremacy Clause of the US Constitution.

“This lawsuit follows two executive orders recently signed by President Trump that seek to ensure that illegal immigrants do not receive taxpayer benefits or preferential treatment,” the Justice Department said.
