Federal District Judge Indira Talwani issued a temporary restraining order extending the "family reunification parole" status of immigrants that was set to expire Wednesday as part of the administration's broad crackdown on immigration.

The ruling, issued Saturday and released Sunday, grants an emergency motion to the affected migrants, which entails a 14-day temporary restraining order against the new measures announced by the Department of Homeland Security (DHS) on December 12.

“The plaintiffs have demonstrated irreparable harm for the purposes of a temporary emergency order. In balancing the interests of the parties, the court finds that an emergency order is warranted,” stated the ruling by Judge Indira Talwani of the Massachusetts District Court.

The order comes a month after the DHS announced it would end the Family Reunification Parole (FRP) program for these seven countries, which would have required immigrants protected by this benefit to leave the United States by mid-January if they lacked another legal alternative to remain in the country.

Talwani stated that immigration officials failed to properly notify those who could lose their legal authorization to remain in the United States, despite the requirement that they receive direct notification.

In contrast, the Trump administration said it planned to provide the required “written notification” to affected immigrants through online accounts, but the judge said some immigrants with “parole” status received electronic notification weeks after the announcement last month, while others claim they were never notified.

The program,Implemented during the Joe Biden administration, it has allowed migrants from these countries to reunite with their families in the United States while awaiting visas or completing their immigration processes. But the Trump administration argued that these programs were misused, maintaining that poorly vetted individuals circumvented the traditional process to obtain this immigration protection. Lawyers for the affected migrants, estimated at between 10,000 and 15,000, have warned of harm to families, including children, because most of them would lose their legal status and have to leave their relatives. Judge Talwani ordered the DHS to submit administrative documents by Tuesday to defend its position and file an appeal against the ruling.
